This legal notice (hereinafter, the ‘Legal Notice’) regulates the use of the Internet website www.biomarmt.com (hereinafter, the ‘Website’) that the entity makes available to Internet users.

The entity has legal personality, full legal capacity and the power to act in pursuit of its objectives, with its own assets and treasury, under the terms established in Organic Law 15/1999, of 13 December, on the Protection of Personal Data (hereinafter LOPD).

2. General Terms and Conditions of Use of the Website

2. 1. General information

The use of the website www.biomarmt.com attributes the condition of user thereof (hereinafter, the ‘User’) and implies full and unreserved acceptance of each and every one of the provisions included in this Legal Notice in the version published by the entity at the time the User accesses the aforementioned website. Consequently, the User must carefully read this Legal Notice each time they intend to use the website, as it may be modified.

The use of certain services offered to Users through the website is subject to specific conditions (hereinafter, the ‘Specific Conditions’) which, depending on the case, replace, complete and/or modify this Legal Notice. Therefore, prior to using these services, the User must also carefully read the corresponding Specific Conditions.

The entity informs you that access to and use of the website www.biomarmt.com and all subdomains and directories included therein (hereinafter collectively referred to as the Portal), as well as the services that can be obtained through it, are subject to the terms set forth in this Legal Notice. Therefore, if you do not agree with the considerations detailed herein, please do not use the Portal, as any use of it or the services included therein will imply acceptance of the legal terms contained in this text.

The purpose of the Portal is to promote the activities carried out and the services provided by the entity, and therefore the information contained therein is intended primarily to inform the User about the services offered, constituting, where appropriate, a mere invitation to contract, but never a binding offer. All products and services contained in the Portal are provided by the entity in accordance with current regulations.

Use of the Entity’s Portal is free of charge for Users. Notwithstanding the foregoing, some of the Services provided by the Entity through the Portal are subject to payment of a price in the manner determined in the corresponding Specific Conditions.

2.3. User Registration

In general, the provision of the Services does not require prior subscription or registration by Users. However, the Entity conditions the use of some of the Services on the prior completion of the corresponding User registration. Said registration shall be carried out in the manner expressly indicated in the service itself or in the Specific Conditions that regulate it.

2.4. Obligation to make proper use of the Portal, Services and Content

The User undertakes to use the Portal, the Services and the Content made available to Users on the Portal in accordance with the law, this Legal Notice, the Specific Conditions of certain Services and other notices, regulations of use and instructions brought to their attention, as well as with generally accepted morals and good customs and public order. To this end, the User shall refrain from using any of the Services and/or Content for purposes or effects that are unlawful, prohibited in this Legal Notice, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload, impair or prevent the normal use of the Services, computer equipment or documents, files and all types of content stored on any computer equipment (‘hacking’ or ‘computer piracy’) belonging to the entity, other Users or any Internet user (hardware and software).

The purpose of these links is solely to facilitate your search for resources that may be of interest to you on the Internet. However, these websites do not belong to the organisation, nor does the organisation review their content and, therefore, cannot be held responsible for them, for the functioning of the linked website or for any possible damage that may arise from accessing or using it.

No website or email address may be linked to the Portal without the express written authorisation of the organisation.

At any time, the entity may withdraw the authorisation mentioned in the previous paragraph, without having to give any reason. In this case, the page that has created the link must proceed to its immediate removal as soon as it receives notification of the revocation of authorisation by the entity.

2.6. Frames

The entity expressly prohibits third parties from applying ‘frames’ or using any other mechanisms that alter the design, original configuration or content of its Portal.

2.7. Privacy

The entity complies with Organic Law 15/99 on the protection of personal data.

Visits to the entity’s institutional portals are anonymous.

However, any data required from the user to access the portal’s services will be incorporated into the entity’s corresponding files and will be processed in accordance with the regulations established by Organic Law 15/1999, of 13 December, on the Protection of Personal Data, Law 8/2001, of 13 July, on the Protection of Personal Data of the Community of Madrid, and other applicable provisions.

The data collected will only be transferred, where applicable, with the prior consent of the interested party or in accordance with the provisions of the aforementioned Organic Law on the Protection of Personal Data.

Persons whose personal data are contained in a file belonging to the entity may exercise their rights of access, rectification, cancellation and opposition, in the manner provided for in the Law, before the person responsible for the file. 3. Intellectual and industrial property rights

Both the design of the Portal and its source codes, as well as the logos, trademarks, drawings, models and other distinctive signs that appear on it, belong to the entity or collaborating entities and are protected by the corresponding intellectual and industrial property rights.

The contents of the Portal are also protected by the intellectual property rights of the entity or third parties. Their use, reproduction, distribution, public communication, making available, transformation or any other similar or analogous activity is strictly prohibited, unless expressly authorised by the entity or such use is strictly in accordance with the terms and conditions of the services offered through the Portal.

The entity reserves the right to take appropriate legal action against Users who violate or infringe its intellectual and/or industrial property rights.

4. Responsibilities

Use of the Portal: Access to the Portal and the correct use of the information contained therein are the responsibility of the person performing such actions, and the Entity shall not be liable for any incorrect, unlawful or negligent use that the User may make thereof.

Use of content: The entity provides all the content on its Portal in good faith and will make every effort to ensure that it is permanently updated and current; however, the entity assumes no responsibility for the use or access made by Users outside the scope of the Portal, for which the User will always be ultimately responsible. Users who act against the image, good name or reputation of the entity, as well as those who use the designs, trademarks, logos or content of the Portal illegally or fraudulently, will be liable to the entity for their actions. Therefore, Users must refrain from obtaining or attempting to obtain information, logos, ringtones, images, drawings, trademarks, sound files and any other audio and/or graphic material accessible through the Portal using mechanisms other than those indicated in this Legal Notice and on the Portal.

Viruses: The entity undertakes to apply all necessary measures to try to guarantee the User the absence of viruses, worms, Trojan horses and similar elements on its Portal. However, these measures are not infallible and, therefore, the entity cannot fully guarantee the absence of such harmful elements. Consequently, the entity shall not be liable for any damage that they may cause to the User.

Technological failures: The entity will make every effort to ensure that the Portal does not suffer any interruptions, but it cannot guarantee the absence of technological failures or the permanent availability of the Portal and the services contained therein and, consequently, it does not assume any responsibility for any damages that may be caused by the lack of availability and by access failures caused by disconnections, breakdowns, overloads or network crashes not attributable to the entity.

Errors in contracting: in the event that the User makes an error in entering the data necessary to carry out the contract, given that this is done by sending an alphanumeric code in a message, the User will not receive the contracted service, without this implying any liability for the entity.

5. Applicable Law

The applicable law in the event of a dispute or conflict of interpretation of the terms that make up this Legal Notice, as well as any issue related to the services of this Portal, shall be Spanish law.
